1. APPLICABILITY

1.1. The General Terms and Conditions below apply to all offers and transactions of Talking Drum. Prices are subject to change.

1.2. By accepting an offer or making an order, the consumer expressly accepts the applicability of these General Terms and Conditions.

1.3. Deviations from that stipulated in these Terms and Conditions are only valid when they are confirmed in writing by management.

1.4. All rights and entitlements stipulated for Talking Drum in these General Terms and Conditions and any further agreements will also apply for intermediaries and other third parties deployed by Talking Drum.

2. QUALITY

2.1. Talking Drum guarantees that all the products offered meet the standards of the concept.

2.2. If there are any complaints the management needs to be informed immediately. Appropriate actions will be taken as soon as possible.

3. YOUR RESERVATION

3.1. Are large groups required to pay a deposit in advance? For group bookings (8 or more), you will be required to secure your reservation with a credit/debit card. No money will be taken from your card at the time of booking. However, please be aware that if you fail to cancel your booking or to inform the restaurant of the reduced number in attendees 24 hours prior to the reservation, we reserve the right to charge your card £30 per person for ‘no show’. It is our booking procedure to secure bookings for 8+ guests with credit card details. In the event that the booking is not honoured in whole or in part by you, or is cancelled by you with less than 48 hours notice it will be at the discretion of Talking Drum to charge £30.00 per person to your card.

3.2. How is my credit/debit card data stored? We use an external company, which is fully PCI DSS compliant, to store all the card details on their system. Those details are temporarily held on their database. Once the booking has taken place the data is removed from the system. This is in Accordance with the General Data Protection Regulation 2018.

3.3. Are telephone reservations limited? Talking Drum accepts a limited number of reservations because we welcome walk-ins at any time.

3.4. Can customers visit our restaurants without making a reservation? We can be busy, especially at weekends and during bank holidays, but we do our best to accommodate our customers on a first come, first served basis. Sadly, some customers may be disappointed by the wait and we apologise for that but cannot guarantee a table at busy times. We therefore ask large groups, or those attending for a special occasion, to book in advance to avoid disappointment.

3.5. Can I make a same-day online reservation? Yes you can, however, please note that it is possible that we may not be able to seat you depending on how busy we are.

3.6. When is my reservation confirmed? Your booking is not complete and legally binding with Talking Drum until you have received a confirmatory email or booking confirmation receipt from the restaurant accepting your booking details. In order to make any reservation with Talking Drum, you must have the legal capacity to do so and you must accept financial responsibility for all transactions made under your name. You must make sure that all the information you provide to us is true and accurate. Booking a table at the Restaurant means you have to pay the Restaurant, usually at the end of your meal. Talking Drum management reserve the right to require customers to pay for their meal before being seated.

3.7. Do I have to provide confirmation of my reservation? On arrival at the restaurant, please give your name and party size to the Host. Please also have evidence of email confirmation on your smart phone or laptop, and your deposit receipt (where applicable).

3.8. How long is my reservation? We operate a maximum 2 hours seating policy. During our busy sessions (generally Friday, Saturday, Bank Holidays and special occasions such as Christmas, Valentine’s Day, Mother’s and Father’s day) this may be reduced to 1 hour 30 minutes at the restaurant manager’s discretion.

3.9. When does my reservation begin? Time begins from the agreed reservation time and is regardless of the time of arrival. Please therefore ensure that you arrive in plenty of time. If you are a large group, we suggest that all guests arrive at least 5 minutes before your reservation time. Failure to attend the Restaurant within 10 minutes of the reserved time will result in your deposit being treated as a “no-show” fee by the Restaurant. When the Restaurant is busy, management reserve the right to seat you once the majority of your guests have arrived to minimise the risk of your party not being able to finish your meal within the allotted time. The Manager cannot extend the time allocation during busy periods.

3.10. Can I bring my own food or drinks to the restaurant? No food or beverages except those supplied by Talking Drum may be consumed within the premises. If you are having a party at Talking Drum and would like to bring your own cake please inform management at the time of booking so that we can confirm this is acceptable on the booking confirmation receipt. Unfortunately, we cannot allow silly string, party poppers or any type of confetti in the restaurant.

3.11. Can some of my guests drink only? No, all guests must order food in order to have alcoholic beverages.

3.12. Can I make a change to the number of guests attending? If your numbers are decreasing, please give us at least 48 hours notice so that we can try to accommodate any changes. If your party is already 8+ people, and you wish to increase the size of your booking, please note that any substantial increase in guest numbers is subject to availability. Because your contract is directly with the Restaurant any queries or concerns that you may have in connection with your restaurant table booking should be addressed directly to the Restaurant via the details set out in the confirmatory email.

4. PRICES/OFFERS

4.1. All offers made by Talking Drum are without obligation and Talking Drum expressly reserves the right to change the prices, in particular if this is necessary as a result of statutory or other regulations.

4.2. All prices are indicated in British Pounds (£), including VAT.

4.3. In certain cases, promotional prices apply. These prices are valid only during a specific period as long as stocks last. No entitlement to these prices may be invoked before or after the specific period.

4.4. Talking Drum cannot be held to any price indications that are clearly incorrect, for example as a result of obvious typesetting or printing errors. No rights may be derived from incorrect price information

4.5. Please note that prices and booking terms and conditions for Festive and Key Dates are subject to change and will be released closer to the date.

5. PAYMENTS

5.1. All prices are including VAT.

5.2. Methods of payment we accept: Cash, Maestro, Visa, Mastercard and American Express.

5.3. For bookings of 8+ people; payment for the final bill will only be taken by a maximum of 2 debit/credit cards.

5.4. The named person for the reservation is responsible for the final booking payment.

5.5. Group bookings of 8+ people will not be confirmed until your payment has been approved.

5.6. All deposits are non-refundable unless Talking Drum cancels the booking.

5.7. A mandatory Service Charge of 12.5% will be added to your bill.

6. CANCELLATION POLICY

6.1. Can I cancel my reservation? If you wish to cancel your booking, you need to write to us no later than 48 hours before your reservation date. Please be aware that if you fail to give us 48 hours notice prior to the reservation for groups of 10 or more, we reserve the right to charge your card £30 per person for “no show”.

6.2. Can the restaurant cancel my reservation? We reserve the right to cancel a booking, but this of course will be without any liability to you and you will be refunded your deposit within 10 working days. We have, at any time for any reason without prior notification to you, the right to terminate or restrict, suspend or terminate your access to Talking Drum.

7. GENERAL NOTICES

7.1. Children under the age of 12 will be entitled to free refills of Coke, Diet Coke, Ginger Beer and Orange Juice.

7.2. Please let your waiter know of any allergies before placing your order.

7.3. Talking Drum closes at 11pm sharp so we kindly ask that all customers vacate the premises by 10:50pm.
